Privacy Notice (KVKK)

1. Data Controller

This privacy notice has been prepared by Moserra Software, in its capacity as data controller, pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data ("KVKK") and Article 4 of the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Disclosure Obligation. Nidiet is a brand operated within Moserra Software.

2. Scope of This Notice — and Its Limit as Regards Client Data

This notice concerns visitors of nidiet.com and dietitians who open a Nidiet account.

Client (patient) data falls outside the scope of this notice. As regards the personal data of the clients of a dietitian using Nidiet — including measurements, diet plans and health data — the data controller is the relevant dietitian. As regards such data, Moserra Software is merely a data processor acting solely on behalf of and in accordance with the instructions of the dietitian; it does not access client data other than for the provision of the service and technical support, does not use it for its own purposes, does not sell it to third parties, and does not process it for advertising purposes. The essentials of this relationship are set out in the Terms of Service.

If you are a client and have a request regarding your data, you must apply to the dietitian who provides you with the service.

3. Categories of Personal Data Processed

There is no contact form to be filled in on nidiet.com. Your data is processed only when you open an account, use the service, or write to us of your own accord, and only to the extent you choose to share.

No special categories of personal data concerning you (the dietitian) are processed within this scope. The health data in the system belongs to the clients and, as explained in §2, the data controller is the dietitian.

5. Method of Collection

Your data is collected electronically: through your sign-in provider when you open an account, directly through your own input when you use the panel, when you create a support request, and automatically by way of server logs.

6. Transfers

We do not sell your personal data. Transfers are made — for the operation of the service, for legal obligations, and, only with your explicit consent, for site analytics and advertising measurement — within the following limits:

Apart from the cases listed above, your data is not transferred abroad. The analytics and marketing transfer depends solely on your explicit consent; it does not take place unless you give consent. If we begin using a new service requiring a cross-border transfer, this notice will be updated in advance.

7. Retention Period

Data relating to your account is retained for as long as your account remains open. If you close your account, your data is deleted or anonymised to the extent that no legal ground requiring its retention remains. Invoice, payment and accounting records are retained for the period stipulated by tax and commercial legislation (as a rule, ten years), and security and traffic records for the minimum period set out in the relevant legislation. The retention and deletion of client data depends on the instruction of the dietitian.

8. Data Security

Data is encrypted in transit with TLS and kept encrypted on the server side. Each dietitian's data is isolated in its own area; one company cannot see another's client. The client portal is protected by two layers — an unpredictable link and a PIN set by the client. Access rights are limited by the need to perform duties, and system records are kept.

9. Rights of the Data Subject (KVKK Art. 11)

Pursuant to KVKK Art. 11, by applying to the data controller you may exercise the following rights:

You may submit your application to info@moserra.com. Your request is concluded within thirty days at the latest. Your application must comply with the procedure set out in the Communiqué on the Procedures and Principles of Application to the Data Controller.

10. Updates to This Notice

This notice is updated when our processing activities change. The current version is always published on this page, and the effective date is indicated at the top.
